General Terms And Conditions of Sale

The following terms and conditions of sale shall apply to all goods sold by D&C Stanton Pty Ltdfor the Stanton Trust trading as The Bead Company ("The Company") to its Customers ("The Buyer").

1. Agreement to sell

Possession of the pricelist does not constitute an offer to sell but is an invitation to place an order. An order placed with the Company constitutes an offer by the Buyer which the Company in its absolute discretion may accept or reject. The Company may accept the offer by notice in writing to the Buyer or by supply of the goods set out in the Order placed by the Buyer.

2. Price

All prices in the price list are subject to change without notice. All offers accepted will be supplied at the price current at the date of shipment to the Buyer, including items on back-order.

3. Title to the goods sold

The property in the specified goods supplied by the Company to the Buyer shall not pass to the Buyer until payment in full for these goods has been received by the Company and the Buyers cheque has been honoured.

The Buyer shall stand in fiduciary relationship to the Company in respect of goods supplied by the Company but which have not been fully paid for and the Company shall have the right to trace the proceeds of sale of such goods received by the Buyer. If the Buyer fails to honour any of these terms of sale, the Company, without notice, shall have the right to take possession of the goods which are subject of this reservation of title, or trace the proceeds thereof, as the case may be, to recover the full amount owing together with interest and costs,if any, to the Company. The Buyer shall hold the goods as being goods in which property has not passed from the Company to the Buyer pending payment in full.

4. Risk and Insurance

The Buyer, by placing an order with the Company, agrees to insure and keep insured goods supplied by the Company whilst those goods are in the possession of the Buyer to the full invoiced value of the goods. Unless otherwise indicated by the Buyer, goods are not ensured when posted through Australia Post or any selected Courier Company. Risk of loss is passed to the Buyer once the goods have left the premises of the Company. If the goods are destroyed, damaged or stolen whilst in the possession of the Buyer, the Buyer agrees to pay the Company the full value of the goods from proceeds of insurance or otherwise, even thought property in the goods may not have passed to the Buyer.

5. Claims

Any claims for damage or loss must be made within 5 working days. No returns are accepted without prior approval. A 20% Re-stocking fee applies to all goods returned. We regret that under no circumstances can Swarovski Articles be returned for credit when ordered specifically for you or purchased in Bulk.

Returns & Refunds

Returns of goods ordered by mail or on-line only

Please choose carefully. No returns are accepted without prior approval.

Note that there is a limit to the colour range displayable on a web page and that colours may display differently on individual computer screens. Nor is it often possible to display sizes accurately. Hence, we are unable to accept any returns or claims that are due to the colour or size of an item.

We are unable to provide a refund simply because you changed your mind or ordered too many articles. You are however entitled to a refund, credit, or exchange if the goods are faulty.

Note that should we accept returns a 20% re-stocking fee will apply to cover the costs associated with the original preparation of the order and preparing a credit note for the return of the goods.

Delivery Details

Delivery & Cost

Postal and packaging charges are separate from your order. Since the destination and size of the order determines the freight costs, we will:

• Prepare an invoice of all available stock ordered
• Quote for the freight or postal charges, considering your preferred method of shipment
• Email you the pro-forma invoice
• Wait for your approval via email
• Process your order subject to you credit card clearance
• Ship your order

For your consideration, the minimum postal and packaging charge is $5 using surface mail. Australia Post also offers a cheap express service for within that does not require a signature. The charges are $6.80 up to 500gram & $9.70 up to 3kg. The items must fit into their satchels. Delivery times are next day CBD to CBD, but generally are two days. Note that the loss of a non registered parcel is outside our responsibility and no credit can be claimed.

Additional charges apply for registered parcels. Please also note that although parcels do get lost, in 20 years of trading we have never had parcel going missing. Goods above 5 kg are normally sent via a freight forwarder within . Delivery times are about 4 days to a maximum of 7 days anywhere in

Outside

We ship to only a selected range of Countries. When you registered with us you filled out a form that asked for the country your in. If your country was not listed, we can not ship to you. However, you may ask for an exemption.

Please stipulate the method of freight required, your options are:

• UPS Express
• Fedex
• General Mail surface/sea
• General Mail air

Please note that we will deduct the 10% Goods and Services Tax that applies to Australian Customers. Hence, the goods will be cheaper. However, you will be responsible for any taxation charges and duties that apply in your country. For further information please contact your customs agency.
